same thing happen to me too, we applied for correction and got corrected PD after one month.
Since my PD was/is not current waiting one more month was not a problem for me.

It reminded me, what my wife's doctor told us 3-4 years ago (my wife is with the same doctor for the last 6-7 years) ? some people in US want to have a child born, when they are getting old ? it took me 3-4 years to understand.
Here is story - My wife take X class of medicines due to diabetes (I think this means medicines can adversly harm growth of a child during pregnency). So doctor was trying to explain, whenever we want to have child what precaution we have to take and how they help in this type of situations. We asked doctor- how could we think of having another baby, when our kids are grown up, one finished MS, the other one is doing BS. Doctor?s reply was that some people in US want to have a child born, when they are getting old ? there are reasons.
After interpreting SSA pages, I think, now I understand economic part of having child in old ages. If Mr A has accumulated enough social security points, Mr. A?s wife is not working, she is of 44 years and she becomes mother, this child is like insurance. If case of death of Mr. A, wife of Mr. A and Child of Mr. A will keep on getting social security benefits (this is up to 16 years). At the age of 60 (minimum age, when one can get Social Security benefits), Mr A?s wife can start getting her own Social Security benefits.
Getting term (life) insurance is not possible without GC. Three agents tried to help me at different times, they did not succeed ? perhaps US lawas are like that. Thinking negatively getting GC may be long wait 5 years, 10 years, 20 years, even 30 years.
Just wondering, is it a common practice to have a child born in old ages as an insurance? Whether H1B people and people at GC path are aware of it?

Looking for a company willing and able to apply for Labor Certification in this short duration, so I can apply for I-140 and I-485 before August 17th.

Hi,
My H1B expired on sept 2009. My employer applied for my visa extension I received my approved 797 copy, but I 94 number on my 797 and passport are not matching. To explain further, when I first entered in US in March 2007 I got I 94 (ex: 123), when I last time entered in US in April 2008 I got I94 (ex: 456) which is my latest I94 number displayed on my passport. My latest H1B extension valid till sept 2012 is showing I 94 number issued to me when I entered in 2007 (123) instead of my latest I 94 number(456) attached to my passport.
Will this be a problem? I have to sponsor my in-laws visa so please guide me how this can be handled. Any help appreciated. Thank you very much in advance.

Receipt notices for 485 ead ap is be receipt date ,,,not COuntry of origin or PD
ur 485 approval will depend on ur PD...and until Oct 2007 all VISAS are unavailable...so atleast till Oct 2007 ur 485 will not be approved...

I am on EB3 with 140 approved. My PD is Dec 2002. My company is ok to give me a promotion and re-apply on EB2. I have roughly 8 years of experience as a software engineer. According to my company's lawyer I may still have a problem because my university education is not in computers. I have 3 years degree in mathematics (BSc) and 2 years in business (MBA). I also have 2 years diploma in computers.
Anybody has any experience with such a case? Any suggestions or ideas?
What is the risk if I decide to take a chance ?

Yesterday I e-filed my EAD and AP renewal for me and my wife but I think I may have messed up a little.
1) I forgot to save the confirmation receipt( pdf) for me and now I cannot get it anywhere. I did save it for my wife. I belive I need this along with the supporting documents. How Can I request the confirmation receipt from USCIS
2) I did not find any instructions come up for the list of supporting documents that need to be sent. Should I send the supporting documents (based on what I saw on this site) anyways?

LCA for H1 not for GC processing. My GC LCA is difefrent than H1B LCA .
I am not sure if any New LCA is required for 485 ...At least my company has not initiated any new LCA..
But they do file for H1B(LCA) if there is any change in work location.

Yes there are limits to salary. I will try to post more details on it when time permits and as I myself find details from my own research.
Basically, stay above what was in your labor/140. Do not go too high, 10% per year raise is ok. Job duties should stay same or similar. You can be a sr. software programmer from a software programmer but not a VP or Architect...(you got my point).
This is a gray area and tough to get a correct advice easily.
This is also a big issue for our community since people cannot get promoted or take big salary raises due to this limitation. Ask people who are stuck in 485 stage for many years.
I know a lot of people are counting days to just jump into a new job after 180 days. But make sure you factor in all the risks when you do this. Be prepared for an RFE on it.
and BTW I am reading so many posts that say you can jump jobs before 180 days. Please do not misrepresent the Yates Memo and regulations to prove a point. You need to stck to the job for 180 days definitely. The only exception is that if you are sure that the job offer will wait for you indefinitely in infinite future when you get an RFE. Do not take immigration laws lightly. And yes, always seek advice from a good lawyer when you take such important decisions. Forums are simply opinions from people without a law degree or experience.
