IV..i140 is such a black hole that people are indiscriminately (or discriminated and ) stuck there...there is no order in processing..people who filed in 2008 are getting approvals whereas people who filed in July-2007 have not even had their fingerprints taken..
I had a petition going a few months back, it was sent in with about 100 signatures, I can send a text of the petition if IV wants to use this and talk to CIS.
The petition was sent to Ombudsman, Sen Lofgren and USCIS Director..
Please help..because many many people with current PD will lose their chances, they need to speed things up now - like they did during June last year..why can't they bring the same momentum..??

Unless the dependent is going to have his 140 filed under EB1 I am not sure it would help.
But to answer your question, I think it is ok to file. Check with your attorney before you do that though

My attorney (Dumbest creature on this earth) filed my I-485 (AOS) application on 30th June, 07 recd. on 2nd July at 10.45 am. I was under this impression that all 3 stages 485/765/131 were filed along to uscis.. but I was wrong. My attorney only applied for 485 saying that they were very busy and will file for 765 and 131 (EAD and AP) after we get 485 adjudicated.. BS..
Anyways.. My question is.. since 485 was mailed out via attorney's office, can I go ahead and apply for 765 and 131 on my own, bypassing attorney's effort or am I stuck with them to wait for their mood-swings to go ahead and file my papers. The deadline with old fees application is 30th July as per the news bulletin. I dont want to waste time for 485 to get adju. and then file for 765/131.
Please advise me about this situation. Also I don't have any proof of 485 application being submitted. I only have tracking number of Fedex that the application was delivered on 2nd July. GOSHH.. pls. advise me.

I am planning to apply for NIW based on my HPSA work location.
My attorney is stating that I need to change work contract to 5 years instead of 3 years for the same. According to him, I can add in the contract that this extention of contract is at discretion of employee after 3 years and it will not damage the interests of my employer.
Since I do not want to work after 3 years with my employer, is this contract language safe for me?
Also is it possible to swelf petition for NIW?

Its true that you have to have valid passport (which is not expiring withing 6 monts) at the time of visa stamping.
Get a new passport before you leave for India. You can apply for a new passport in India Consulates in USA. Google it and you will find out more.

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
3. Is it necessary that immigrant visa petition (greencard) is in process before applying for K3 visa?

I blogged about the Sessions E-Verify proposal yesterday. Well bill, that passed by voice vote this morning, but not before the Senate voted down a proposal from Senator Schumer to table the Sessions proposal. Senator Leahy, in an astute move prior to the vote on Sessions' E-Verify bill, amended that bill to include a permanent extension of the EB-5 Regional Pilot Program. So, Leahy's amendment permanently extending the EB-5 Regional Pilot Program was approved too!
Senator DeMint from South Carolina threw in a bill to mandate the construction of actual fences along 700 miles of the Southern Border, taking away the right of DHS/CBP to decide how best to protect that border. That has also passed.
Senator Hatch has now introduced a bill which includes positive changes including undoing the Widow Penalty, and a religious worker extension and a rural doctors program extension. You can still call the Senate Switchboard to voice your support for this latter bill, and your disgust with the Senate passage of laws without debate that will affect millions of lives and cost billions of dollars. You can reach your Senator by calling 202-224-3121.
All of these amendments, of course, must now go back to a conference committee with the House, and there is no guarantee that any of them will become law. But, lest you thought your time to relax from calling your Congressman was over, it has now started again. I just wanted to throw this out there, since I did not get any definite answer from any forums.
When in need for I-485 issues, who is better to contact - Congressman or Senator.
I just want to know the pros and cons of each and maybe this analysis will help others down the line.
Points to note are:
1. There are more congressman in a particular state than senators. There are only 2 senators in a state.
2. Senators are more powerful than congressman (not sure that this power applies for talking to USCIS or not)
3. Senators and congressman have different terms in office. Hence is it better to contact someone who is going to stay longer, or someone who is up for election soon and hence may help.
4. For a particular USCIS case, can we contact both congressman and senator at the same time. Is this good.
Can members throw some light on this based on their prior experience and based on their knowledge.

You can say 'Yes', but it will trigger unnecessary questions from IO. I am not sure about the consequences. If I were you, I would say NO as its not full time course and not going to change the status to F1. I beleive you should say 'YES' only if you change to F1 visa in the future.

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?

This is a shot of emerging cinnamon fern heads. Captured with the Sigma EX 105mm macro lens and 20D, in manual at 1/400 and f/5.6. Shot handheld, lying on my side on a catwalk in the middle of a swamp. I was particularly pleased with the lighting and detail.

Yesterday I booked a visa appointment at the Mumbai consulate and no where on any of the forms did I specify that I was from Maharashtra but the appointment letter that comes out at the very end says in bold "State of Residence: Maharashtra" which is wrong.
I also canceled the appointment and re-booked it with the same outcome.
Has anybody had this happen to their case? Just trying to gauge how concerned should I get about this. Everything else on the forms looks correct but this one little thing.
