The U.S. House of Representatives concurred today with the Senate Amendment to H.R. 5116, America COMPETES Reauthorization Act of 2010 by a bipartisan vote of 228 to 130.
The bill aims to maintain national economic and scientific leadership by: supporting basic research; improving science, technology, engineering, and math (STEM) education; and fostering innovation, especially the development of new energy technologies.
Nothing much or anything significant....a broad high level to do things...like science and technology education to be improved...

Employment Letter is a part of the initial evidence. There is a memo recently saying that any missing initial evidence will result in denial of application without RFE. Try to cajole your employer and gather as much evidence as you can about being asked for $$$ for helping you file 485

I would have to agree that the colouring is really nice in the first picture. However, I've always been big fan of sepia toned b&w photographs. It's pretty easy to find some good actions for Photoshop, and then you can play around with it from there. I think the faded edge would look really good with the sepia. (really works with an aged photo)

I also have the same status. I think it has to do with finger printing when had filed for 485 during July 2007. My status is like that since Dec 2007 .Nothing has changed after that for me..

Hello,
I am working with A on h1b and the visa expires on May 1st 2010.
Recently I got another offer with B and they filed my h1b transfer (regular).
The offer they gave me verbally is different from what's on the offer letter, when I contacted them there insist that they never "promised" , so I did not want to take that offer now.
Can I now ask employer A to file the extension and continue working with A?. Will that create any issues if the transfer with B gets Approved/rejected?. or is there any alternate?. Please help.

There is nothing like H1 transfer. Each petition is separate. Company B filing H1 does not invalidate your H1 from Company A. Your original H1 will still be valid even if H1 from company B is approved/denied. You can just continue working with company A and file extension when its due...

I am using my EAD and working for the company which filed by PERM/I-140/I-485. Currently I am being paid a lot more than the prevailing wage on the PERM so my company has suggested me that they will give the amount listed on the PERM as a salary and the remaining as a check to the company that I own. I have a business in my name but all I did was register the company name; never actively ran the business.
Please share your concerns/opinions about the possibility of above scenario. Do you think taking the salary and B2B expense would cause a problem with the green card process?

Hi Guys,
As always thanks for all of your help who are out there and lending a hand to each other in this immigration mess.
After denial of I-140 (EB3) in November of 2007 in response to my A2P RFE, I filled for appeal in December 2007. Now my case is in appeal with AAO. My H1b is expiring in June 2008. I am hoping to get an extension based on my pending appeal.
In the meantime, another company has offered me a job and agreed to file the labor of my behalf. In the current situation of mine, where appeal is pending, which will take a long time for the final decision, my lawyer suggested to file the new labor through that company and this time under EB2 catagory. I dont have masters degree but I have BS computer science and now more than 5 years of US experience. He suggested EB2 since for my home country EB2 is always current.
I just want to get an opinion for all of you about this situation of mine, and filing labor under Eb2 cat under PERM. The position in the new company is Senior Security Analyst and requires Masters degree or 5 years of experience.
Also , what is the process of getting extension on H1b while appeal is pending and how early should I file the extension before June 2008.

Hi,
I have a PERM approval in EB2 with PD Sept 2005, and I140 approval few days back. I will be entering my sixth year in H1 shortly, wanted an advice whether to go for 3 year extension or 1 year extension, are there any demerits of 3 year extension with respect to H1 transfer in case of layoff, etc?

My in-laws came to visit us on vistor visa(B1/B2) .
They got 6 month of stay in their I-94.
My father-in-law left US 2 day's before I -94 expiry but with my mother-in-law's I-94. Before he left I applied for the extension of stay(I539) for my Mother-in-law.
Her I-539 got denied stating the person has already left.
Now in my mother-in-law's passport we have my father-in-law's I-94. So actually at the port of entry the officer switched the I-94's.
Now the question is now how to handle the denial of extension for mother-in-law and get new I-94? and what to do with father-in-law's I-94.

Your attorney should have asked for extension starting with June 15th, since old I-797 work authorization expires on June 14th, 2010.
Now, you are in status, but can not work from June 15th until June 24th. That could be leave without any pay.
